This website www.workpositive.ie is operated by wellhub on behalf of the Health & Safety Authority and the National Treasury Management Agencywellhub’ is a trading name of Employee Wellbeing Limited. Employee Wellbeing Limited’s (No. 558120) trading address is Clara House, 37a Upper Dunmurry Lane,  Belfast, County Antrim, BT17 0AA. Registered in Northern Ireland. VAT Reg No. 872 2791 02. 

wellhub's websites are maintained for your personal use and viewing. Access and use by you of wellhub’s websites constitutes acceptance by you of these Terms and Conditions, which take effect from the date of first use.

The term ‘you’ refers to the user or viewer of the Surveys and/or our website (the “Site”). The Surveys and any other services provides to you via this Site are referred to in this Agreement collectively as the “Services.” Employee Wellbeing Ltd may modify or change the Services at its sole discretion. Employee Wellbeing Ltd is only willing to make the Services available to you if you accept and abide by this Agreement. In the event of your noncompliance, fraud or other inappropriate activity (as determined by Employee Wellbeing Ltd in its sole discretion), Employee Wellbeing Ltd may cancel your account or restrict your access to and use of the Services. By accessing the Services, you acknowledge and agree that this Agreement will be construed and evaluated according to the laws of Ireland, Northern Ireland, England, Scotland and Wales. If you use this Site or access the Services from other locations you are responsible for compliance with any and all applicable local laws.

 

Registration

The Services may be used only by persons 18 years of age or older. Use of the Services is void where prohibited. By accessing or using the Services, you represent and warrant that you meet are fully able and competent to enter into, and abide by, the terms of this Agreement. If requested, you agree to (i) provide accurate, current and complete information about you as may be required by any registration forms on the Services; (ii) maintain the security of your password and login credentials; and (iii) maintain and promptly update the information you provide during registration, and any other information you provide to Employee Wellbeing Ltd, so as to keep it accurate, current and complete. Registration may require information that includes without limitation your full legal name, the name of your company and your working email address.

 

Fees

There is no fee for the use of the HSE Work PositiveCI tool in standard format as it is sponsored by the State bodies concerned. 

However, fees may be charged by Employee Wellbeing Ltd. to use additional ‘add-on’ services beyond the scope of the standard provision. Employee Wellbeing Ltd (or its partners) may, in its sole discretion, elect to charge fees for their add-on services, or alter their fee structure in that regard at any time, but must give advance notice of same to the end user. At no time will the end user of either tool be required to make any purchase when using the site. However, if you do elect to purchase add-ons, you will be responsible for payment of any such fees, which shall be listed at checkout.

 

Participation

You agree to participate in good faith and to the best of your ability in any survey activities in which you participate in connection with the Services. You will not intentionally provide false or misleading data, including without limitation, survey responses that are inconsistent with prior responses or statistically improbable.

 

User Content

You may provide information to Employee Wellbeing Ltd in connection with your participation in Surveys or otherwise in connection with the Services, including providing survey responses, ideas, feedback, or other information or content (“User Content”). By providing any User Content, you represent and warrant that you have the lawful right to provide it, and that it is accurate and complete. You must not provide any User Content or otherwise make any use of the Site that: is unlawful, libellous, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, false, inaccurate, misleading, fraudulent, or impersonates or misrepresents an affiliation with any person or entity; would violate an obligation of confidentiality or the rights of any person or entity, or that would otherwise create liability or violate any local, state, national, or international law; infringes any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any person or entity; contains or collects any private information of any person or entity, including, without limitation, addresses, phone numbers, email addresses and credit card numbers; or in the sole judgment of Employee Wellbeing Ltd, is objectionable, does not reflect your good faith efforts to be responsive to survey questions, or which may expose Employee Wellbeing Ltd (or its partners) to liability of any type.

 

Non-Use and Nondisclosure

Information and content made available to you through the Services may contain trade secrets or other confidential or proprietary information of Employee Wellbeing Ltd and/or Employee Wellbeing Ltd’s partners. You must hold in strict confidence and not disclose to any other person any information and content that you access or learn in connection with your participation in any survey, project, questionnaire, or other market research activity related to the Services. You must not use any such information or content for any purpose other than your participation in the Services in accordance with this Agreement. You hereby agree to notify Employee Wellbeing Ltd immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in this Agreement.

 

Intellectual Property

The National Treasury Management Agency and the Health and Safety Authority own the copyright in the HSE Work PositiveC website and the material and content featured on same (with the exception of third party logos displayed on the website).  Employee Wellbeing Limited is authorised to host this website on behalf of the National Treasury Management Agency and the Health and Safety Authority, and to carry out the functions described on this website. The copyright protected material or content contained on this website may be reproduced free of charge for educational purposes in any format or medium, provided that (i) it is reproduced accurately, (ii) it is not used in a misleading context, (iii) the source of the material or content is identified, and (iv) the copyright status is acknowledged.  Use of the copyright protected material or content for commercial gain is strictly prohibited.

 

Disclaimer of Warranties; Limitation

Your use of the Services, including any Content, is at your sole risk. The Services and all Content are provided on an “as is” basis. We do not warrant that the functions within material contained on Employee Wellbeing Ltd websites will be uninterrupted or error free, that defects will be corrected, or that this site, or the server that makes it available, are free of viruses or represent the full functionality, accuracy, or reliability of the materials. In no event will we be liable for any loss or damage without limitation, including indirect or consequential loss or damage; or any loss or damages whatsoever arising from use or loss of use of, data or profits arising out of, or in connection with, the use of Employee Wellbeing Ltd websites.

 

Use of Data

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, original or creative materials, or other information or content provided by you to Employee Wellbeing Ltd, to the extent it is not User Content, will become the sole property of Employee Wellbeing Ltd. Employee Wellbeing Ltd will own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of such information and content for any purpose, commercial or otherwise, without acknowledgment or compensation to you. Further, you hereby grant to Employee Wellbeing Ltd a perpetual and irrevocable license to use such information and content for any purpose.

 

General

Any provision of this Agreement that is found to be invalid, unlawful, or unenforceable will be severed from this Agreement, and the remaining provisions of this Agreement will continue to be in full force and effect. The section headings and titles in this Agreement are for convenience only and have no legal or contractual effect. Any provisions in this Agreement that by their nature should survive the termination of this Agreement (including, without limitation, provisions governing indemnification, limitations on liability, disclaimers of warranty, and ownership of intellectual property) will continue to remain in full force and effect after the termination of this Agreement.

This Agreement, including all terms, policies, and guidelines referenced in this Agreement, is the entire agreement between you and Employee Wellbeing Ltd concerning the Services. This Agreement supersedes all prior agreements or communications between you and Employee Wellbeing Ltd regarding the subject matter of this Agreement.

 

Critical Incident Survey content

Whilst all of the Critical Incidents listed in the CISM Work Positive Survey and Job Content CI Audit are clearly defined and relative to varying occupational roles, the survey responses are based on staff perceptions, not organisational fact or records.

 

Hyperlinking to Employee Wellbeing ltd websites

You do not have to ask permission to link directly to pages hosted on Employee Wellbeing ltd websites, as we do not object to you linking directly to the information that is held there. However, we do not permit our pages to be loaded into frames on your site. Employee Wellbeing ltd pages must load into the user's entire window.
